Influencer Marketing

My background is in consumer protection law, so I know there are some major players out there looking to fight the good fight for consumers. ⁣

Last month, TINA (Truth In Advertising) filed a complaint with the FTC, naming 1400 individuals and over 500 different companies regarding their continued failure to abide by the FTC’s advertisement disclosure guidelines. These guidelines were enforced amongst 21 different celebrity endorsements back in 2017 but no substantive action has since been taken. ⁣

Influencer marketing is on the rise, and therefore so is awareness surrounding the legalities of marketing this way.

If you are an influencer, or have ever been involved with influencer marketing, *please* check out the FTC’s guidelines.⁣

“Won’t my contract protect me?” Not always. Make sure your agreement addresses FTC disclosures. Influencer marketing is relatively new, and some companies aren’t even using contracts for these deals yet - let alone including the proper language regarding necessary FTC disclosures. ⁣
