Common Trademark Mistakes

Brainstorming a name for your new product/service/business launch now that it’s 2020? ⠀

Here’s 3 very common issues you may run into if you are looking to, at some point, trademark your brand name. 🤯⠀

Take these into consideration when naming that launch!⠀

❌ Too Confusing. The USPTO, when reviewing your trademark application, will look at whether or not the mark (aka the name) is too confusing, or too similar to another registered mark. FYI: This doesn’t just mean if it’s *exactly* the same! This also means if the name sounds similar, looks similar, gives off a similar impression to another registered trademark!⠀

❌ Too Descriptive. If the name of the mark simply just describes the business/brand itself, the USPTO won’t register your mark. (Think if a makeup company were called “Makeup Company.” This application would be denied).⠀

❌ Geographically Descriptive. If the USPTO finds that you’re using the name of a location (a city, county, country, etc.) they may not allow you to protect your Trademark. Something like “Los Angeles Businesswomen” wouldn’t cut it.⠀
