3 Common Trademark Mistakes ⁣

Here are some of the most common (don’t worry, it’s not just you) trademark mistakes that I see. Make sure to take these into consideration when naming your business or brand! ⁣

1) Too Confusing. The USPTO, when reviewing your trademark application, will look at whether or not the mark (aka the name) is too confusing, or too similar to another registered mark. FYI: This doesn’t just mean if it’s *exactly* the same! This also means if the name sounds similar, looks similar, gives off a similar impression to another registered trademark!

2) Too Descriptive. If the name of the mark simply just describes the business/brand itself, the USPTO won’t register your mark. (Think if a makeup company were called “Makeup Company.” This application would be denied). ⁣

3) ™ vs. ®. The registered symbol (®) is to be used ONLY once the USPTO has granted registration of your mark. Use of the ™ gets a little tricky. You can use this mark to put the world on notice that you’re claiming your mark...just make SURE that you’re not infringing on someone else’s mark. ⁣
