What's In a Name?

I come across so many truly clever & creative business names on Instagram DAILY. You are all so brilliant - and the mama lawyer bear in me just wants to make sure you’re protecting your amazingly creative brands!⁣⁣

Step one: Make sure that *before* you spend all that money marketing your business/brand that you do your due diligence to find out whether or not someone else is using your business or brand name. The safest way to make sure you’re in the clear is through a comprehensive trademark search.

Step two: Once you make sure no one else is using that name, trademark it! ⁣
⁣⁣
***For my fellow Jefas - if your business or brand name includes word(s) in Spanish - consider the translation of your business name. The name could still cause a “likelihood of confusion” with another trademark in another language.

What does that mean? If your business name is simply the Spanish version of something that already has a registered trademark in English or another language - we may have a problem. ⁣⁣
