Trademark and LLC

You might be surprised to learn - maybe both, or maybe just one.

A Trademark ensures your legal ownership of your business name. (FYI, even if you: own the domain name, have the social media handle, registered your DBA, or filed your LLC - none of these secure *actual* legal ownership ). ⠀

Why do you want legal ownership?⠀
1. So that you make sure no one else owns the name before you start using it (potential for infringement lawsuit); and ⠀
2. So that you can stop others from using the name you legally own! ⠀
⠀
/on the other hand.../⠀
⠀
A Limited Liability Company (LLC) protects your personal assets in the event that your business is held liable for something. ⠀
⠀
*Business insurance is still a must, too - but business insurance won’t cover everything.*⠀
⠀
So the short answer: you should, in many situations, have both.
⠀
Which one should come first? Depends on the risks you’re trying to avoid. Assessing the potential risks are always important for your specific situation, so make sure you speak with an attorney! ⠀
