1. WHEN SHOULD I START THE PROCESS?
The earlier, the better. If you've picked a name, logo, or slogan for your business, you should complete a comprehensive search on the name ASAP to ensure it's safe to use.
2. HOW LONG DOES IT TAKE TO GET A TRADEMARK?
If you're filing at the federal level, the USPTO is currently taking 6-7 months *just* to assign your application to an Examining Attorney... meaning at least one (1) year to get registered. Start early!
3. HOW MUCH DOES A TRADEMARK COST?
Federal filing fees are currently $250/class of goods and services. If you file on your own, you only pay filing fees. But the USPTO highly suggests you work with an attorney - most will charge you a flat fee to help draft, file, and monitor the application.
4. DO I NEED REALLY A TRADEMARK?
If your business name/logo/slogan is eligible, then yes. Aside from protecting your business’ assets, intellectual property and establishing proper legal foundations is a crucial step in the long run.
5. WILL [ your business name ] GET ACCEPTED?
This depends on several factors.
Is your name descriptive? In another language? Similar to another registered trademark or pending application? Speak with an attorney to asses your chances!
